1. Entity holding the promotion

The company Nani Marquina SL, with registered address at Carrer de l'Esglèsia 10, planta 3, 08024 Barcelona and with official ID number B72891567 is organising a global prize draw (hereinafter, "the Promotion"), which will be held on Instagram, exclusively for users residing in countries where the company has a commercial relationship with distributors, in accordance with the provisions of the clause on participation requirements.

2. Start and end dates

The Promotion will start on February 27th, 2023, at 08:00h and end on March 5th, 2023 at 23:59:59.  

3. Participation requirements and workings of the promotion

Requirements governing participation are as follows:

• Individuals residing in countries where the company has a commercial relationship with distributors and who are over 18 years of age may participate.
• Only those participants who have an Instagram account can participate.

To be able to enter the prize draw, Participants must:

• Follow the @nanimarquina_official profile.
• "Like" the post announcing the prize draw.
• Comment on the post while also tagging 2 friends with a profile on the social network.
• Participants will have more chances to win if they share the post in their profile stories, tagging the profile @nanimarquina_official.
• Participants will have a higher chance of winning if they write multiple comments on the same post, provided that different users are tagged in each comment.
• Participants may only participate using a single Instagram profile. If we identify that a participant is using several Instagram profiles, they will be disqualified.

4. Conditions of the promotion and prizes

The winner will be chosen using the CommentPicker platform. The winner will be announced on March 6th through the brand's social media profiles.

• The prize will consist of a Shade Palette 3 rug measuring 170x240 cm with a value of €1,706.10.
• The prize cannot be exchanged for cash or for any other prize, nor is it subject to change or alteration.

The Company reserves the right to modify the prize if, on the day of declaring the winner, there are stock problems and, therefore, it is impossible to give the prize stated above. In this case, a prize of the same value would be awarded.

The winner may contact the Company during a period of 1 week from the date They are named on the brand's social media profile. In case they do not contact us within the stipulated period, a second draw will be carried out and, if necessary, a third draw. If the 3 draws result in disqualified winners as a result of not complying with the participation requirements, the draw will be declared null and void.

The holding of the prize draw, as well as the awarding of the prize, are subject to current tax regulations.

5. Disqualifications and penalties 

If it is evident that any of the Participants does not meet the requirements set forth in the Requirements, or the data provided to participate is not valid, their participation will be considered null and void, and they will be automatically excluded from the Promotion, losing all rights to the prizes awarded by virtue of this Promotion. The Company reserves the right to declare the draw null and void.

6. Posting of comments or opinions

Comments or opinions considered inappropriate, offensive, insulting or discriminatory or that could violate the rights of third parties will not be allowed. Comments targeted against an individual who violates the principles of the right to honour, personal and family privacy and personal own image are also forbidden. We will not be responsible for the damages caused by the comments made by Participants in this Promotion, nor those that could at any time cause offence to other Participants.

Participation in this Promotion, as well as the posting of comments made by Participants in their posts, may not under any circumstances violate Instagram’s Community Rules or Instagram’s Conditions of Use.

If the use of fraudulent means for participation, such as the use of bots in comments, is identified by the Company, the prize will not be awarded to the designated winner and will remain the property of the Company.

7. Waiver of liability

By way of example, but by no means limitation, we are not responsible for possible losses, thefts, delays or any other circumstances attributable to third parties that may affect the holding of this Promotion, nor are we responsible for the use made by the Participant of the prize awarded as part of the Promotion.

We do not assume responsibility in cases of force majeure, or unforeseen events that could prevent the promotion from taking place or the total or partial enjoyment of the prize.

In the event that this Promotion cannot be held, either due to fraudulent participation, technical faults or any other reason that is not under the control of the Company and that affects the normal holding of the Contest, we reserve the right to cancel, modify, or suspend it.

8. Protection of personal data

The Company responsible for the processing of your data is Nani Marquina SL, registered at Carrer de l'Esglèsia, 4, planta 3, 08024, Barcelona, with the official ID number B72891567.

In accordance with the provisions of the General Data Protection Regulations, participants who accept the present Legal Regulations consent to the incorporation of their personal data into a file, with full ownership of pertaining rights and with the purpose of managing the draw, as well as communicating and posting the results, in addition to delivering the prize.

We inform you that you can exercise your rights of Access, Rectification, Deletion, Opposition, Limitation of treatment, Portability, Removal, and ability to opt out of automated decisions by sending an e-mail to rgpd@nanimarquina.com or by writing to the following address: Carrer de l'Esglèsia, 4, planta 3, 08024, Barcelona; attaching in both cases a copy of your official ID.

Without prejudice to any other administrative appeal or judicial action, the Participant shall have the right to file a claim with a pertinent Control Authority, in the event that they consider that the processing of their personal data is not in compliance with the regulations, as well as in the event that the exercise of their rights is not satisfied. They can do so in the Member State in which they habitually reside, work or where the alleged infringement has occurred. In expressing agreement with these conditions, the Participant declares to have been informed of the conditions on protection of personal data by accepting and consenting to the aforementioned processing of data.

9. Changes and acceptance

We reserve the right to modify or expand upon these promotional regulations, provided that such modifications do not harm or impair the rights of the Participants in the Promotion.

The mere act of participating in the prize draw implies that the Participant fully accepts the conditions of these Legal Regulations. Likewise, participation in a draw of this nature implies acceptance of the rules of Instagram, in its capacity as the official platform where the prize draw is to be held.

10. Applicable laws and jurisdiction

These legal regulations shall be governed in accordance with the laws of Spain. The Courts and Tribunals of the city of Barcelona will be deemed competent to resolve any claim or dispute that may arise in relation to the validity, interpretation or compliance with these regulations.
